Immigration Enforcement (IE)

At various points of entry and within a certain distance from the U.S. border, authorities need to ensure their compliance with U.S. immigration law. Primarily, this refers to the authority of U.S. Customs and Border Protection (CBP) and Immigration and Customs Enforcement (ICE) to inspect, question, and detain individuals based on their immigration status. The resources below will help you understand the extent of the authority that these agencies have and the rights you have within these areas.

100 miles from Border

Often called the “border zone”, immigration enforcement agencies within 100 miles of the U.S. border have broader authority to conduct stops, searches, and detain individuals. Resources under this category help you understand your rights in this zone, especially when it comes to searches and questioning by authorities.

At Port of Entry

At a port of entry, immigration officers have the authority to inspect and question individuals entering the U.S. Although you are entitled to be treated fairly, authorities may ask questions regarding your purpose for entering, your immigration status, or your plans during travel. These resources provide you with best practices to utilize in these situations.

At the Border

At the physical U.S. border, immigration enforcement has the authority to stop, search, and question individuals. Understanding that your rights can vary at the border is key, as some protections may be limited compared to other areas of the U.S. These resources help educate you on what rights you still have at ports of entry.

US-Mexico Border

The U.S.-Mexico border is heavily monitored by immigration authorities, where you are subject to heightened scrutiny by customs. Knowing what to expect can help reduce uncertainty about what’s allowed at the border and what protections you have in this area.
